• Marks Tey: Man sentenced after fatal A12 collision

    A man has been sentenced for causing a fatal collision on the A12, after an investigation by specialist officers.

    Marcin Zabicki died after the motorbike he was riding was struck by a Volkswagen Golf on the A12 near Stanway at around 4.40am on Saturday 3 September last year.

    Forty-six year-old Marcin had been on his way to see family in Colchester at the time having just finished work in Chelmsford. He was described by his partner as a “loving father, partner and son, and an amazing friend”.

    Following the collision the driver of the VW Golf failed to stop at the scene, but was located at a nearby service station at junction 28.

    Officers found the car and the driver – Nicholas Sparkes – where he was arrested.

    Sparkes failed a roadside breath test and later provided an evidential sample which returned a reading of nearly three times the legal drink drive limit.

    Sparkes, 27, of Bickling Close, Ipswich, was charged with Causing death by careless driving while over the prescribed limit and dangerous driving.

    He admitted these charges at Chelmsford Crown Court on 16 October and was sentenced at the same court yesterday, Friday 24 November, to five years and four months in prison for the offence of causing death by careless driving whilst over the prescribed
    limit.

    He was also sentenced to six months imprisonment for dangerous driving following the collision which will run concurrently.

    Sparkes was also disqualified from driving for a total of 92 Months and will be required to complete an extended re-test after this period.
