• European Court of Human Rights: Lost Hope for Justice

From Yuriy Sheliazhenko@21:1/5 to All on Tue Feb 12 08:05:32 2019
    Dear colleagues,

Results of journalistic investigation, published in the Pravdoshukach Newspaper (*), revealed the outrageous decline of procedural justice and prevalence of corrupted practices in the European Court of Human Rights.

Shady politics, conflicts of interests and austerity measures make European Court of Human Rights practically incapable to deal fairly with individual applications about violations of the Convention for the Protection of Human Rights and Fundamental
Freedoms. Instead of improving own effectiveness and accountability, the Court seeks excuses to wave away 9 petitions of 10 and punishes lawyers for persistent petitioning.

Apotheosis of the Court's shame was backstage disbarment of independent Ukrainian lawyer Nataliya Tselovalnichenko for petitioning against Russia and Ukraine in the interests of the victims of war in Donbass, arranged by Ukrainian judge Ganna Yudkivska
who's husband Georgii Logvynskyi organized in Ukraine cartel of lawyers trying to monopolize legal aid to the victims of war, manipulate and use them, convert them into clientele of own political party "People's Front" (military and law enforcement lobby,
linked to far-right vigilantes such as infamous Azov battalion and Myrotvorets centre).

The mission of the press is to convey the truth, even if the truth is painful. Many years European public opinion was trusted blindly to the smart machinery of human rights justice and wisdom of professional judges; it seems that the European Court of
Human Rights failed to satisfy public trust.

We understand it is hard to believe in the failure of highly trusted institutions, but here are the facts. ECHR press service confirmed the shocking fact of making criminal accusations against a lawyer without any public hearings and refused to publish
any detailed reasoning, not to mention evidence, in support of published in press-release vague accusations against Ms.Tselovalnichenko. Also, as you can see at 4th page of the newspaper, even the Supreme Court in Ukraine, with all flaws, with a budget
less in half, shows many times better statistics of judicial performance than European Court of Human Rights.

It is time, finally, to admit that the right to individual petition before European Court of Human Rights is a broken promise – and consider seriously the question, how can we restore lost hope for human rights and European justice. Indeed, it worth a
    broad public discussion.

We hope you can support legitimate public demands to start extremely needed reforms of the Court and to revise unjust decisions taken in a corrupted manner. If you like to discuss the reform of the Court, the pages of Pravdoshukach Newspaper are opened
    to publish your opinion.

    Sincerely,

    Yurii Sheliazhenko
