    DALHOUSIE UNIVERSITY & UNIVERSITY OF KING'S COLLEGE, HALIFAX NS: SOME OF THE MOST RACIALLY QUESTIONABLE UNIVERSITIES IN CANADA, NO-GO FOR REFUGEES, BLACKS, FIRST NATIONS & RELATED RACIAL GROUP: SECRET KEPT DURING TORY GOVERNMENT


    Tory government affirms under blind power, that any Human Rights Activists and others that expose this racially cruel danger in Canada is designated as mentally ill person and their children and parents could be arrested, seized and send to maximum
    mental health institution or prison where they can be medicated if they oppose threat to the economic and other interest of Canada and maybe mistreated like the First Nations children, youths and parents.


    The course work or brochures of Prof. Anthony Anns and Prof. Benjamin Mitchell were investigated by students who are very versatile in information science and technology and they found several hundreds of pages of multiple plagiarism littered here and
    there without telling students the sources of the brochures.


    This matter is before the law courts of Nova Scotia but the Judges there are so racist and more racist than the professors and instructors at Dalhousie University and University of King's Colleges that are committing serious crime of plagiarism and they
    are granted amnesty.


    The Honourable Justice Denise Boudreau is the only judge in the Supreme Court of NS out of over 25 judges that have heard his cases since 1999 who denied The Endowed Prof.(Dr.) Phillip Chukwuma Ofume the right to speak in court proceedings after he has
    indicated the sign by raising up his hand over 10 times without allowing him to talk.


    Justice Boudreau did not allow Prof. Ofume to take seat on the side of the Bar where the student was sitting as directed by another judge because Prof. Ofume and his groups are the Advocates, Intervenors and Representatives for the students.


    Prof. Ofume and Associates are requesting these universities, RCMP and Canadian Security Intelligence Service to arrest, investigate and prosecute these professors and also charge the Senate President for obstruction of justice.


    Suspected to be on basis of race and colour Dalhousie University, University of King's Colleges, Senate, Police, etc delaying the investigation of the plagiarism crime committed by these professors.

    May It Please My Hon. Justice:

    Applicant's Opposition to the Respondents' Answer to Keynes Ofume v. University of King's College - Motion to Extend the Deadline to File a Notice for Judicial Review. Motion mark-up to be held on February 17, 2016 at 2 p.m.

    I. OVERVIEW

    1. Purpose of this Motion is to request My Lord to Extend the Deadline to File a Notice for Judicial Review which was deliberately made to pass the 25-day statutory deadline because the Prothonotaries and Assistant/Deputy Prothonotaries were secretly
    working with Dalhousie University and University of King's College that dissuaded them to fail to mark-up the first date Applicant and his representatives, intervenors and advocates came to the Law Court Administrative Office to file their Notice of
    Petition for Judicial Review. Each day of this visit to

    the Nova Scotia Law Courts, the Prothonotaries and Assistant/Deputy Prothonotaries give Mr. Ofume and his representatives, intervenors and advocates conflicting court instructions to delay the process to file Applicant's Notice of Petition for Judicial
    Review.



    2. Applicant and his representatives, intervenors and advocates have been coming to the Supreme Court of Nova Scotia since late June 2015 to file their Notice of Petition for Judicial Review but pursuant to the Nova Scotia Civil Procedure Rules 82.21(1)(
    2) the Prothonotaries and Assistant Prothonotaries failed to do the following process: [("Nova Scotia Civil Procedure Rules 82.21(1)(2)"]

    Issuing order approved by judge or made by prothonotary 82.21 (1) The prothonotary may issue an order by signing the order, sealing it with the seal of the court, and filing it.

    82.21(2) The prothonotary may provide a duplicate that is also signed and sealed, or provide a certified copy, to a person who delivers a copy for duplication or certification.

    3. The Endowed Prof.(Dr.) Phillip Chukwuma Ofume & Associates have represented the Applicant, Mr. Keynes Ofume during all the hearing of the Senate Disciplinary Committee Members which jumped three (3) or four (4) Administrative Fair Hear Jurisdictions
    or levels to start hearing the frivolous allegations by two professors that are friends and were copying from the internet to teach students at Dalhousie University and University of King's College without citing sources of their work. To stop Mr.
    Keynes Ofume's Complaint against


    4. My Lord, please accept my following Opposition and my Affidavit Evidence sworn on 2016 (Keynes Ofume Affidavit) in support of the Applicant's Opposition to University of King's answer to my Motion to Extend the Deadline to File a
    Notice for Judicial Review (hereinafter " Motion")

    5. If my Motion to Extend the Deadline to File a Notice for Judicial Review is granted I will prevail on appeal because no Judge in a civilized judicial system will grant decision on condition of lack of jurisdiction pursuant to Nova Scotia Civil
    Procedure Rules 4.07 where Senate Disciplinary Committee Members failed to follow the following step by step administrative fair hearing rule at University of King's College:

    5.a. Preliminary or initial meeting consisting of the Professor, Instructor, student and his/her parents or Advocate/Intervenor/Representative

    5.b. Department of Arts and Social sciences consisting of the Professor, Instructor, student and his/her parent or Advocate/Intervenor/Representative ;

    5. c. Faculties of Arts and Social sciences consisting of the Professor, Instructor, student and his/her

    parent or Advocate/Intervenor/Representative

    5. d. Academic Integrity Officer consisting of the Professor, Instructor, student and his/her parent or Advocate/Intervenor/Representative

    5.e. Senate Disciplinary Committee Members consisting of the Professor, Instructor, student and his/her parent or Advocate/Intervenor/Representative


    6. In courts where there is equity in delivery of justice to all, jumping one prong of the afore-listed jurisdictions must lead to the dismissal of the decision appealed.

    7. Reference to the fore-going issues in the applicant's Overview, applicant affirm that he has good case and his Motion to Extend the Deadline to File a Notice for Judicial Review be granted because the allegations of Prof. Benjamin Mitchell and Prof.
    Anthony Anns are retaliatory against Mr. Ofume because of his Complaints against these professors.




    II. STATEMENT OF FACT

    7. Mr. Keynes Ofume was admitted at Dalhousie University to study Bachelor of Arts (BA). Mr. Ofume took only one course at University of King's College (HSTC 1801 -History of Engineering and Technology).
    .

    8. Mr. Keynes Ofume was the only Black student at University of King's College class.

    9. The Counsels for Dalhousie University, University of King's College, Academic Integrity Officer (Dr. Gary Kynoch), Mr. Robert Mann and Mr. Dean Jobb are fake and frame up evidence to deceive this Honourable Court and to distort the principal
    evidence in support of the evidence to dismiss the decisions of Dalhousie University and University of King's College because of lack of jurisdiction (Nova Scotia Civil Procedure Rules 4.07 ).

    10. The Counsels for Dalhousie University and University of King's College are more confused because they don't know the type of evidence or exhibits and related documents to assemble to support their motions, affidavits and arguments because:

    10.a. The Counsels for Dalhousie University and University of King's College want to use falsification of Exhibits as marked and attached in the Affidavit of Mr. Keynes Ofume and dated July 17, 2015 to deceive this honourable court because they knew
    that this Court will dismiss the decisions of Dalhousie University and University of King's College pursuant to Nova Scotia

    Civil Procedure Rules 4.07.

    10.b. The Counsels for Dalhousie University and University of King's College are scared of the power of the Exhibits of Mr. Keynes Ofume in support of this Motion or Opposition which show that any misconduct emerging from these universities must start
    from the following administrative fair hearing pattern:


    10.b. i. Preliminary or initial meeting consisting of the Professor, Instructor, student and his/her parent or Advocate/Intervenor/Representative

    10.b. ii. Department of Arts and Social sciences consisting of the Professor, Instructor, student and his/her parent or Advocate/Intervenor/Representative ;

    10.b. iii. Faculties of Arts and Social sciences consisting of the Professor, Instructor, student and his/her parent or Advocate/Intervenor/Representative

    10. d.iv. Academic Integrity Officer consisting of the Professor, Instructor, student and his/her parent or Advocate/Intervenor/Representative

    10.d. v. Senate Disciplinary Committee Members consisting of the Professor, Instructor, student and his/her parent or Advocate/Intervenor/Representative

    11. During the entire proceedings below there were:
    11.a. An attempted and failed meeting intended to put in place by the Academic Integrity Officer (Dr. Gary Kynoch) on March 13, 2015. Meeting failed because for no just reason Dr. Gary Kynoch want second consent letter of Mr. Keynes Ofume which is not
    necessary because Mr. Ofume has submitted letter of consent to Dalhousie University and University of King's College.
    11.b. Due to the childish conduct of the professors at these universities, smart people may ask in issue, whether Mr. Keynes Ofume is required virtue of the regulation of these universities to provide second consent letter before Dr. Gary Kynoch will
    move this important meeting on March 13, 2015 even when Dr. Gary Kynoch has no jurisdiction to hear Prof. Benjamin Mitchell and Prof. Anthony Anns' Complaint because Head of Department and Dean of Faculty have not been given any opportunity to hear the
    Complaint below.

    11.c. After this failed meeting, instead of rescheduling the meeting for another date, Dr. Gary Kynoch, Dalhousie University and University of King's College jumped to Senate Disciplinary Committee Members without the hearing of the Head of Department,
    Dean of Faculty and Academic Integrity Officer. If not the discrimination of Judges in this court, this alone is sufficient for any transparent and impartial Judge to dismiss the fake allegation against Mr. Ofume, because Mr. Ofume has rights

    to investigate the coursework of his professors and report his findings to the Head of Department; Dean of his Faculty; Academic Integrity Office and Senate Committees; police; Law Courts, Prime Minister of Canada, Premier of NS, etc.

    11.d. On March 13, 2015 Dr. Gary Kynoch (white) arrogantly showed up in the meeting room and without seating down, had improperly interrogated The Endowed Prof.(Dr.) Phillip Chukwuma Ofume & Associates (Black) and Dr. Gary Kynoch claimed an unwarranted
    power to do and undo including demanding for another consent of Mr. Ofume while disrespectfully standing up and swiftly walkout and used Senate Disciplinary Committees to issue several threat on Mr. Keynes Ofume and his Representatives, Advocates and
    Intervenors.

    12. When Prof. Ofume made reference to the letter of consent which Dr. Kynoch had in his office on March 10, 2015, March 11, March 12, 2015 and March 13, 2015 up to 10.30 a.m. when the meeting is supposed to be moved with the hope that he has accepted
    the previous consent which Mr. Ofume filed with Dalhousie University and University of King's College because Dr. Kynoch had over 3 days to oppose the letter of consent but he did not. Arrogantly, Dr. Kynoch imposed the date of the meeting on Mr. Ofume
    and his Representatives, Advocates and Intervenors without consulting them. Dr. Kynoch is suspected to be one of the racist from the Defunct Apartheid Regime of South Africa recruited by Canada to support racism, racial discrimination, xenophobia and
    related intolerance against Blacks, First Nation, etc.

    13. Shocking to Prof. Ofume, when the meeting was about to start, Dr. Kynoch angrily requested for
    another signed consent of Mr. Ofume.

    14. Because of the letter of consent which Prof. Ofume made reference to, Dr. Kynock was highly infuriated and walked out on Prof. Ofume and Prof. Anthony Enns who were still sitting and waiting for Dr. Kynock to arrive and he was late to the meeting
    without apology and he adjourned the meeting unprofessionally or without date to continue the meeting.

    15. Dr. Kynock was harsh and rude to Prof. Ofume because he Dr. Ofume is a Black and he did not see another or second letter of consent of Mr. Ofume whereas he caused the problem because for three days he did not e-mail or telephone Mr. Ofume to request
    him to send another consent and/or he had the letter of consent for several days.


    EMERGENCE OF CONFLICT AT UNIVERSITY OF KING'S COLLEGE

    16. Prior to enrolling at University of King's College, Mr. Keynes Ofume attended Institute of Modern Technology and worked for several years as global and community instructor in Information Technology to enable poor communities and youths earn income
    to help themselves and their families by writing good article for money.
    17. In the classes of Prof. Benjamin Mitchell, Mr. Ofume suspected wrong teaching and learning materials and used his experience in modern information science and technology to

    review the teaching materials of Prof. Benjamin Mitchell and he was surprised to see the worst and severe acts of multiple plagiarism on the course papers of these professors. (see attached Applicant Affidavit sworn on February , 2016)



    18. Applicant informed the Faculty of Arts and Social Sciences and these professors and the following days, he observed anger on the faces of these professors and some staff and they were not responding to his greetings in the morning, afternoon and
    evening.


    19. When the severance of the anger of the staff and these professors (Benjamin Mitchell and Anthony Anns) became intolerable, the applicant reported to The Endowed Prof.(Dr.) Phillip Chukwuma Ofume & Associates and they wrote to the Head of Department,
    Faculty of Arts and Social Sciences and there was no action taken to investigate his complaint.

    20. Very shocking the applicant received letter from Dalhousie University and University of King's College and Prof. Anthony Anns and his instructor Ms. Brea Marks and Prof. Benjamin Mitchell alleged that Mr. Keynes Ofume committed act of plagiarism and
    the Senate obstructed justice and the Senate is directly and vicariously liable for criminal investigation of obstruction of justice.

    21. Senate decided to hide Prof. Benjamin Mitchell and Prof. Anthony Anns and they decided to leave English Department and now hiding in a place called Department of Russia Study.


    22. The Endowed Prof.(Dr.) Phillip Chukwuma Ofume & Associates and applicant made several photocopies of the weblinks and connections of plagiarism to the course materials of these professors and sent them to Dalhousie University and University of King'
    s College and to the following agencies of the government of Canada:

    23. The investigation is on-going and they have requested for the telephone numbers and

    addresses of these professors but the Dalhousie University and University of King's College have refused to disclose these important contact information but the RCMP is supposed to proceed to look for these professors if not eyes on white privilege in
    Canada.

    RESOLVED COMPLAINT AT DALHOUSIE UNIVERSITY & UNIVERSITY OF KING'S COLLEGE

    Complaint Against Prof. Danen Poley of Department of English for Under-scoring Applicant and How this Complaint was Resolved. (see attached Applicant Affidavit sworn on February , 2016)

    24. In this complaint, there were several meetings at the Department of English and Faculty of Arts and Social Studies.

    25. The days which the Dean did not attend, he send message through the Dean's Office and after these meetings, the matter was resolved.

    26. Prof. Anthony Anns, Senate Committees, instructor (Ms. Brea Marks) and Prof. Benjamin Mitchell want to use harassment and bullying to force Mr. Ofume and his representatives/ Advocates/Intervenors to forcible abandon their Complaints against Prof.
    Anthony Anns, instructor (Ms. Brea Marks) and Prof. Benjamin Mitchell. Further boost is based on the experience of my parents in the NS law court where judges align with whites lawyers and white parties to derail justice.

    SENATE DISCIPLINARY COMMITTEES USED POWER TO ABANDONED THE ADMINISTRATIVE STEP BY STEP COMPLAINT PATHWAY

    27. Restating that under the Administrative Fair Hearing process of the Faculty of Arts and Social Sciences at University of King's College, the following hearing step by step is available:

    27.a. Preliminary or initial meeting consisting of the Professor, Instructor, student and his/her parent or Advocate/Intervenor/Representative

    27.b. Department of Arts and Social sciences consisting of the Professor, Instructor, student and his/her parent or Advocate/Intervenor/Representative ;

    27.c. Faculties of Arts and Social sciences consisting of the Professor, Instructor, student and his/her parent or Advocate/Intervenor/Representative

    27.d. . Academic Integrity Officer consisting of the Professor, Instructor, student and his/her parent or Advocate/Intervenor/Representative

    27.e. Senate Disciplinary Committee Members consisting of the Professor, Instructor, student and

    his/her parent or Advocate/Intervenor/Representative


    27.a. At King's College meeting between counselor or professor and student is held. First year students are merely advised and if such mistake repeat 0% score maybe given to the student.( (see attached Applicant Affidavit sworn on February , 2016)


    28. Unlike Prof. Anthony Anns and his instructor Ms. Brea Marks and Prof. Benjamin Mitchell, there was no meeting at the Department of English. In the Complaint against Prof. Polen there were several meetings and in one of the meetings, the Dean of
    Faculty and Head of Department of English were in-attendance in person or by message and the matter was resolved and the case closed at the Department and Faculty Level.


    29. When allegations of academic conduct were filed against the Applicant by Prof. Anthony Anns and his instructor Ms. Brea Marks and Prof. Benjamin Mitchell, the whistle blowing position of the applicant angered the Senate Committees and they
    unlawfully boycotted all the fair hearing opportunities such as Department of Arts and Social sciences; Faculties of Arts and Social sciences; and Academic Integrity Officer and set up two illegal senate hearing committees headed by: Prof. Bruce P.
    Archibald and Prof. Susan Holmes with certain amount of law experience, failed to advice the track derailing Senate Disciplinary Committees. (see affidavit of Mr. Keynes Ofume sworn on February 2016)

    ERUPTION OF DISPUTE BETWEEN MR. KEYNES OFUME AND UNIVERSITY OF KING'S COLLEGE & PROF. BENJAMIN MITCHELL



    Mr. Keynes Ofume has Strong Resume in Information Science and Technology and he know Canadian Copyright & Dal. University & King's College Plagiarism guidelines:

    30. In the world of information technology and science Mr. Ofume has strong experience and skill to help his community, youths and family survive during unemployment time and short list of his experience is as follows:

    30.a. He is detail oriented and have a broad range of interests in Canada Writing Copyrights Law including knowledge of plagiarism inside and outside University of King's College and Dalhousie University.

    30.b.. He has detailing experience; and comprehensively and thoroughly, up-to-date familiarity with American/Canadian social culture, media, copyright and web culture

    30.c. Excellent comprehension and written communication skills in English

    30.d. A broad range of experience, that works through the specific areas of expertise

    30.e. Excellent web research skills and analytical abilities

    30.f.. Ability to work independently under minimal supervision

    30.g. Possess a wireless high speed internet connection (DSL, Cable Modem, etc.)

    30.h. Attended Institute of Modern Technology, Lynn, MA USA. (see attached Affidavit)

    31. Applicant attended Executive Trainers Preparation Training at 5LINX UNIVERSITY, 5LINX World Headquarters 275 Kenneth Drive Suite 100 Rochester, NY 14623 USA which is distance online education and the Completion .Certificate earned is attached in
    Applicant's attached Affidavit sworn on January 25, 2016.


    Why is very Important to Allow or Grant Motion to Extend Time to File Petition for Notice of Judicial Review

    32. If there exist Natural Justice, Constitutional Justice, Right of Whistleblowers and Human Right in Nova Scotia and Canada in general in both ancient and modern times, let this case be heard by impartial Judge in this court.

    33. Without allowing this case to proceed to Judicial Review, the heartless order of the Senate Hearing Committees have placed lifeline strain on all efforts of the Applicant to further education now and future.

    34. No one can be punished because of his/her whistle blowing efforts to be the life of other people. The release of the internet copy of the teaching materials which these professors copy from the internet without citing the author of the handout
    given to students is the only issue which brought the allegations against the Applicant.

    35. The Senate Hearing Committees, Prof. Anthony Anns and his instructor Ms. Brea Marks and Prof. Benjamin Mitchell, Dalhousie University and University of King's College have made students and other know the allegations and told several lies against
    Applicant which destroyed his reputation as information science and technology youths instructor for small income business people in the community.


    36. In the same Department of English the conduct of Prof. Danen Poley of Department of English of Dalhousie University was reported and resolved according to the process and procedural rules at Dalhousie University and University of King's College. (see

    Unlawful Jurisdiction is not Tolerated in Canadian Administrative, Commission, Tribunal and Court Hearings

    37.The Supreme Court of Canada: See the case of: Halifax (Regional Municipality) v. Nova Scotia (Human Rights Commission), 2012 SCC 10, [2012] 1 S.C.R. 364
    The Judges heard that "The appeal should be dismissed...Judicial intervention is not justified at this preliminary stage of the Commission's work."
    "Administrative law -- Judicial review -- Standard of review -- Complaint filed with Nova Scotia Human Rights Commission -- Commission requesting appointment of board of inquiry -- Decision set aside on judicial review -- Board prohibited from proceeding
    -- Appeal allowed -- Whether chambers judge applied correct standard of review -- Whether Commission erred in requesting appointment of board of inquiry." "A judge of the Nova Scotia Supreme Court set the referral decision aside and prohibited the board
    from proceeding. The Nova Scotia Court of Appeal reversed and cleared the way for the board of inquiry to go ahead."
    The position of the University of King's College and outlook of resolution of case of Plagiarism
    38.1. At the University of King's College, Complaint starts from the department level and new students are treated as people that are new that they should be advised based on the first incident of the suspicion of Plagiarism or if the incident repeat the
    student will be given failing grade, etc.
    39. Lack of jurisdiction by the Senate Hearing Committees, Applicant allegation which was submitted by Prof. Benjamin Mitchell with the Department of Technology at the University of King's College was not submitted with the Department of Technology at
    University of King's College but was moved by unknown person to the Senate Discipline Committees without all the four hearing levels below exhausted before unknown person purportedly acting on behalf University of King's College recommended for first
    year or new students complaint be moved improperly to the Senate Discipline Committees without given the Department, Faculty and Academic Integrity Officer to hear the complaint before it was moved to Senate Discipline Committees. (see attached Applicant
    Affidavit sworn on February , 2016).

    40. Several other students victims that were drilled into this frivolous allegation were bullied, harassed and brought into different close door hearings and convicted and given terrible in-house probation which unjustly lasted several months with
    destructive academic punishment which will continue to stick on their academic transcripts.

    41. To prevent the universities from foreign intervention, save time, money, and ensure Justice, The Endowed Prof. (Dr.) Phillip C. Ofume & Associates filed administrative motions pursuant to the Nova Scotia Civil Procedure Rules 4.07, 8 & 9 but
    Professors Susan Holmes and Bruce P. Archibald (Panel Chairs) denied their Motion and blindly proceeded on the Senate Committee Hearing without jurisdiction pursuant to the Nova Scotia Civil Procedure Rules 4.07 with the hope below and above (
    Administrative and Court) that white supremacy will give them bogus pious judgment to oppress the Applicant. [Also see The Supreme Court of Canada case in the matter, Harelkin v. University of Regina [1979] 2 S.C.R. 561. Date: 1979-03-30]


    42. What on earth would prevent Professor Susan Holmes from dismissing the Complaint of Prof. Benjamin Mitchell who dropped a Complaint against Mr. Keynes Ofume and after Mr. Ofume found several acts of plagiarism on his course materials and filed
    Complaint against him with the RCMP & CSIS, swiftly Prof. Mitchell fled University of King's College to unknown nation and Prof. Mitchell did not attend any of the administrative hearings below but due to the plot they conceal reliant on forcing Mr.
    Ofume to abandon his complaint, Professor Holmes did not dismiss Prof. Mitchell Complaint pursuant to the Nova Scotia Civil Procedure Rules 4.07, 8 & 9. (see attached Applicant Affidavit sworn on February , 2016).


    III. Relief

    Pursuant to the breach of the Nova Scotia Civil Procedure Rule 4.02, Applicant request Your Honor to grant Applicant's Application to extend the deadline to file Notice of Petition for Judicial Review and also because Applicant has good case in line with
    The Constitution Act, 1982 - The Constitution Act, 1982, being Schedule B to the Canada Act 1982 (UK), 1982, c 11. The fundamental rights to freedom of speech or whistle blowing is secured under this Act because Applicant has rights to speak out
    against the fraud committed by the professors and protect the rights of students in Nova Scotia and Canada in general. (see attached Applicant Affidavit sworn on February 16 , 2016).

    In a transparent court and other places of record, this Constitutional and Jurisdictional pathways will lead to the dismissal of the entire hearing and decision of the Senate Hearing Committees because the Senate Hearing Committees did not apply
    correct standard of hearing which starts from the Department of English (See paragraph 17 above and attached Applicant Affidavit sworn on February 16, 2016) which comes with preliminary Standards Form to file Complaint at Dalhousie University and
    University of King's College.

    Human Rights or Whistleblower's work of the Applicant which served the purpose of the protection of the entire students at Dalhousie University and University of King's College because each year over 300 outspoken students including new students inside
    and outside classroom are expelled from Dalhousie University and parents including applicant's parents cry and cry because of the heavy students' loan they have to pay back to the government severally under low income. (see attached Applicant Affidavit
    sworn on February 16 , 2016).

    Applicant request this Court to grant his application because the Senate Hearing Committees have no right to hear the complaint of Prof. Anthony Anns without all the appeal mechanism below.

    Applicant also seeks other compensation which this Hon. Court deems fit.
