Can a U.S. company hire a foreigner abroad as an employee and never have him/her enter the U.S. or get a visa?
Yes, a US company can definitely hire foreign employees without having those individuals go through immigration or deal with H-1B visas.
There are a few different ways to go about this. As most people on this thread have mentioned, one option would be to set up a legal foreign entity in a different country. This is a good long-term solution where you would be able to compliantly employ
individuals in that country while maintaining full control over them. The drawback with this however, is that setting up a legal entity is not only costly, but it can take an average of 3-4 months to establish and begin operating.
If you’re looking to onboard your supported employees quickly and compliantly, International PEO is a good option to consider. This solution acts as the Employer of Record (EOR) for your company’s global workforce and handles the contracts, payroll,
and compliance, while your company would actually manage the daily activities of your staff.
