A new superseding indictment was filed Thursday against Baltimore City
State's Attorney Marilyn Mosby.

The charges are the same; however, prosecutors added new evidence to the
charge regarding mortgage fraud that prosecutors say strengthens their
case against Mosby. WBAL-TV 11 News found video that supports a part of
that claim.

Mosby is facing federal charges of two counts of perjury and two counts of making false statements on a loan application.

The indictment now includes a letter that prosecutors said Mosby sent her
loan broker as part of a mortgage application for the property she
purchased in Longboat Key, Florida.

The letter, dated Dec. 10, 2020, mentions Mosby already has another
property near Disney World, and she and her family had been living there
for the previous 70 days.

Prosecutors said that wasn't true.

Mosby was in Baltimore at least one of those days and held a news
conference that 11 News attended. The news conference on Dec. 7 was to
announce the creation of the sentencing review unit. It's possible Mosby
could have returned just for that news conference and left right after.

Prosecutors also added a claim that Mosby submitted a "false gift letter"
to the mortgage company, saying her husband gifted her $5,000 to be
applied to the cost of the home. Prosecutors said the money actually came
from Mosby herself and was made to look like it was a gift.

Mosby's attorney responded Thursday evening to the new indictment, calling
it "shameful" and slamming prosecutors, saying they're trying to shame
Mosby three months before her election.

Mosby has announced she is running to keep her job as Baltimore City
state's attorney; however, she has yet to officially file. The deadline to
file for candidacy is March 22, and the primary election is June 28.

Mosby's attorney further said the government is "scraping the bottom of
the barrel when federal dollars are being spent to investigate money transferred between a husband and wife."

Mosby has repeatedly said she has done "nothing illegal, nefarious or
wrong". WBAL-TV 11 News has reached out to Mosby's office for comment on
the new superseding indictment.

The U.S. Attorney's Office offered no further comment beyond releasing the court documents.

Friday is the deadline for the prosecution to file a rebuttal to the
defense motions to dismiss. The defense will then get until March 25 to respond. Both sides have until April 4 to file any other motions.

Then, a motions hearing is set for April 14 and a jury trial is scheduled
to begin on May 2.
