    always use the latter. I can't think of any other way to approach the
    sort of question you've reraised.

    Time should be available soon. SCOTUS has accepted my petition for
    certiorari, so I have a few weeks without litigation. Pretty tough
    to meet scotus demands for the form and content of that document. The
    petition has to be submitted in a "perfect binding" booklet sized 6 and
    1/8 by 9 and 1/4 printed both sides of the page using typeface in the
    "century" font family, 40 copies.

    In the meantime I've given some thought to the question underpinning
    this discussion. he working definition is expansive and complex, so
    I need just a bit more time, but rest assured, it is coming.
