SCOTTS VALLEY, Calif. —
A 5-year-old was stabbed and killed during a fight with his twin brother
in what law enforcement is calling a tragedy.

According to the Santa Cruz County Sheriff's Office, around 4 p.m. on Wednesday, two 5-year-old twins were fighting when one of them got a
small kitchen knife and stabbed his brother.

The victim was taken to the hospital but ultimately died from his
wounds.

No criminal charges will follow the death.

"In coordination with the District Attorney’s Office and in light of all circumstances discovered by our investigators, no charges will be filed
against anyone involved," the sheriff's office reported. "California law dictates that age, criminal intent, and knowledge of wrongfulness are
factors needed to charge a child with a crime."

"We are heartbroken for the family of these two young children and share
in their grief," wrote Ashley Keehn, the public information officer for
the sheriff's office.

The incident took place in an unincorporated part of the county near
Scotts Valley.
