    Dear Mr. Wertz:
Please be advised that we have been retained to represent the
interests of H-E-B, LP, and its partners, in connection with an
alleged incident involving the H-E-B Pharmacy. Please consider
this a notice of representation and forward all future
communications to my office accordingly. Thank you for your
    immediate attention to this matter.

    Sincerely,
    F ARMER, H OUSE , OSUNA & OLVERA

    ---------------

Which complaint is this regarding? The original complaint for
which there was a supposed private settlement. Or the lawsuit I
filed in Travis County justice court against H-E-B and Netspend
regarding the monies from that settlement having been stolen
    while in their possession?

J3-CV-24-000232 STEVEN ALAN WERTZ vs. NETSPEND CORPORATION, H-E-B
    Prepaid, LLC.

The way I see it the resolution of the first incident depends on
the second and are now related.

Netspend has 3 days to respond. I think they're chicken.

I can't tell if H-E-B has been served that lawsuit yet as the
courts are closed today. But I suspect you have seen what has
already been filed and the evidence. I will probably be modifying
that suit now that I, too, have seen the evidence (which was not
privy to me when I first filed).

Shall I expect a response on that from you - is that what you're
    saying?

    Sincerely,

    Steven Wertz

They didn't tell you about that part. Eh?

Churn it over with Netspend that the $520 claim is $783 to drop
it. The court fees and settlement will cost about $885 and more
    (when I can't lose).

If not resolved by the end of the week, I'll double that in court
for just being obnoxious pricks (Netspend, mostly - HEB for
    turning blind eye).

And if I were to miraculously lose, brings up the pharmacy
incident (have you seen my hospital and ambulance bills since
    then?)

Oops, Times up. $803.13 resolves current claim with both parties
which resolves pharmacy claim [again]. Just give me my money
back, dammit@!@! You see the evidence! (assuming they sent it to
    you, oops!).

End of week is the 'Point of no Return' (for you).

If you're not representing H-E-B on the below referenced case and
just the "pharmacy incident", then I guess we now may have a
    conflict since I just assumed....

Oops. My bad <shrug>. I didn't hear from you.

    Me to the Court:

I just received defendants answer. I would like to modify the
monetary value of the claim since evidence has come to light after
I filed the original petition. Can I do that in open
court/hearing or do I need to submit a revised petition? How
    informal is this?

The defendant did not indicate I could communicate with them
electronically, unlike I graciously indicated upon myself. Do I
have to formally service them again on any revisions to the
petition (if the above is not generally considered?)

If I can petition for modification of damages in open court, lets
put it on the calendar. No other motions or discovery needed.
They must have bumped their widdle heads. And I'm sorry to have to
take the court's time on this.

    Sincerely, and Thank You,

    Steven Wertz

Making money at your keyboard is actually very hard work,, however
    you do it.

    To Lawfirm:

    -----
Your usage of 'partners' as in "...we have been retained to
represent the interests of H-E-B, LP, and its partners" will have
a different meaning when argued in the courts.

I assumed you meant H-E-B as well as all the H-E-B imprints. And I
gave you privileged information on that case based on that
assumption, and on your demand letter. You solicited information
from myself that you should not have been privy to.

We now have an issue here. Can you folks not stop fucking up?

Call Netspend. Tell them to give me the $803.13 and I will drop
the cases against both of you resolving you of court costs.
Otherwise we'll both jack those costs up. END OF WEEK! The court
costs alone are already up to $925 (including original demand)

It's so simple. Don't make it hard. You should have my number.

I've dropped H-E-B from the lawsuit since Netspend is taking
    center stage on this.

I guess since Google is no longer archiving posts here,
there's no sense documenting this for the record. Here is
my email to ... lets see. ..Somebody at Netspend today. I'm
    such a lovable guy, eh?

You will of course hear of my eventual victory 50 days from
now, but I will spare y'all the intermediate details from
    now on.

What is this in response to: My complaint with the
Department of Banking, my complaint to MasterCard, my
complaint to the H-E-B lawyers, my complaint to the CFPB, my
numerous emails to legal@netspend.com, or my lawsuit filed
in Travis County? (hope to see you there!)

I'm still suing you and the judge (or jury) will think
otherwise. Consider this your 30-day notice of my suing you
as per your 'request' for notice in your TOS.

I have also filed a claim with MasterCard for return of my
money in accordance with their "Zero Liability Policy",
while I pursue the remainder of the damages with you,
    Netspend, in the local courts.

I had already scheduled a callback to discuss my claim with
your 'dispute analcyst' 13 days ago and that never happened.
I was sent a snarky response instead that the case was
closed and they would not speak with me.

So I'd be pretty stupid to do that again, eh? I consider
your email equally as ineffective. You didn't look at
