• Police shooting videos leaves questions unanswered

    Civilian Office of Police Accountability (a city agency that investigates police) just released video of a shooting on March 21 on the west side
    of Chicago. The driver of a vehicle pulled over for a traffic stop,
    a 26 year old man, is dead. Police say he shot first (not clear from
    provided video); four officers fired. One police officer was hit in the forearm. There is video from a neighbor's surveillance camera that
    implies that the officer, on the passenger side of the vehicle, was hit.

    The office recommends relieving police officers who shot at the man of
    powers during the investigation. I think that means full suspension with
    pay, not just desk duty.

    Now, for a traffic stop, the vehicle was surrounded by multiple tacticle officers. This makes no sense. Clearly, police identified the vehicle
    and, because he had pending gun charges (no state ID and no state
    concealed carry permit), I'm guessing they wanted to perform a search to
    see if he was still carrying. Among the gun charges from having been
    found with a gun at a major picnic was "unlawful use" despite not
    threatening anyone.

    He also had a retail theft charge but that was dropped, implying there
    was no gun use.

    I don't know what orders police had already given the driver that we can't
    tell from this one video, but he was ordered to roll down his window,
    which he did but he rolled it back up again part way. He was also ordered
    to roll down a rear window, which we don't see. He was also ordered to
    unlock the doors and open them, which he did not do. Then we hear gunshots, lots of gunshots.

    It seems to me that they were already proceeding to take him into
    custody before we see this video's footage. If it were an ordinary
    traffic stop, you hand over required ID and proof of insurance as
    ordered by the officer, but the purpose of rolling down the window is to
    allow the officer to visually search, and that gets into the rules of reasonable suspicion and probable cause. The driver has civil rights
    against warrantless search to assert.

    The traffic stop was for a seat belt violation?

    It was Windy City Smokeout, with country music bands and restaurants.
    It's in the parking lots of United Center, middle of July. It's attended
    by 18,000. Attendees must wear wristbands. Weapons are prohibited, and
    they do search attendees. I assume that's how he was arrested.

    Could you please comment on what I was asking about, whether the cops
    were attempting to perform an unconstitutional search of his vehicle
    for illegal weapons since he doesn't have permits?

    Way back when I was in high school people thought it was funny to peel the little update tag off other peoples license plates. I was on my way home
    from school and some cop noticed the missing tag. He not only pulled me
    over he called in and I found myself surrounded by three police cars and
    six policeman. Who have collared a teenage kid in a 71 gremlin a block
    from his parents house.

    Now I knew about the tag but back in those days the only place you could
    get a replacement tag was halfway to where BTR lives and it was only open during banking hours on weekdays. So I had to write for a replacement tag
    or skip a day of school. I had a copy of the request for the replacement
    tag in my glove box, and in fact it had been processed and the tag was on
    the way.

    So now I have an embarrassed and very angry police Sergeant on my hands and five Junior cops snickering at him.

    He orders me to skip school and drive across town illegally since I don’t have tags and try to get a tag from DMV which they aren’t going to do
    because they’ve already mailed me my tag.

    Phoenix police can be real assholes. It’s one of the reasons I moved to Scottsdale.

    Sounds like what happened to a friend of mine back in college. He was
    driving home when he found himself pulled over with multiple cops with
    guns pulled out and pointed at him in the car because his car matched
    one used in a bank robbery. On the hand I got stopped heading home
    from college by a state trooper so I got out of the car and waited
    against the back of the car while he did what ever in the car. When he
    got out he asked for my ID and talked to me for a minute explaining
    why he stopped me (a similar car was involved in some crime) and took
    a minute to mention I had a tail light that wasn't fully working (a
    bulb had gone out) and then sent me on my way.

    Same happened to me in Maryland as me and three other agents were on our
    way back to the office from lunch. We found ourselves surrounded at an intersection by cop cars on all sides, cops piling out and pointing guns
    at us. There'd been a bank robbery a few miles away minutes before and
    the thieves shot someone as they fled in a red Dodge Charger. I was
    driving a red Dodge Charger.

    The cops were screaming at me to shut off the car and get out and I knew
    the last thing I wanted to do was get out of the car in front of all
    these adrenaline-hyped guys who are pointing guns at me with my own gun
    on my waist. Yes, there was a badge right next to it but why risk your
    life on betting they don't have tunnel vision? So I turned off the car
    and then activated all the police lights on my car--front windshield,
    grill, both side windows, and rear, burped the siren a few times, and
    then turned on my radio's PA and blasted out for them all to hear,
    "There are four armed federal agents in this vehicle. Run the tags and
    you can verify the agency it is registered to. We'll wait with our hands visible while you confirm. We do not want to emerge from this car with
    our duty pistols on our persons with 20 cops pointing guns at us."

    Thirty seconds goes by and all the cops lower their guns and we get out
    and resolve the issue.

    on my waist. Yes, there was a badge right next to it but why risk your
    life on betting they don't have tunnel vision? So I turned off the car
    and then activated all the police lights on my car--front windshield,
    grill, both side windows, and rear, burped the siren a few times, and
    then turned on my radio's PA and blasted out for them

    I’m amazed that that didn’t turn it into a Bonnie and Clyde situation


    all to hear,
    "There are four armed federal agents in this vehicle. Run the tags and
    you can verify the agency it is registered to. We'll wait with our hands visible while you confirm. We do not want to emerge from this car with
    our duty pistols on our persons with 20 cops pointing guns at us."

    Thirty seconds goes by and all the cops lower their guns and we get out
    and resolve the issue.
