• Concerns Judges getting "creative"

    This is something which needs attention.

    It appears to me that the situation could end up like the Supreme Court in America.

    While we are along way there it does appear that with a bit of a push and a shove from the idealists we could end up with the Courts starting to stroll onto Government's turf.

    We really don't have anything in common with the USA in respect of the judiciary. In the USA there is a widespread practice of judges being
    either appointed by elected officeholders or elected to office.
    Neither apply in NZ, so there is really no linkage unless you can
    credibly identify it.

    Judges have no business establishing law, that is the job of government. Neither Malpas, or the National party people he refers to, or Gordon
    have made any claim that judges have been establishing law. It is
    however their job to interpret that law in the light of evidence and
    sentencing guidelines. If they get it wrong, there is an appeal
    process. The four strikes law was so bad that there were rumours of
    police being careful of charges in some cases - the National-led
    government of the day grumbled, but had the sense not to appeal the
    sentences which they realised reflected the opinions of many National supporters . . .
