• Apple is trying to trademark depictions of actual apples

From badgolferman@21:1/5 to All on Tue Jun 20 12:42:12 2023
Apple is trying to trademark images of apples – the fruit, not the
    computers.

Apple has been trying to trademark the apple in Switzerland since 2017
and has launched similar applications in several other countries, per
Wired UK(opens in a new tab). It submitted an application to the Swiss Institute of Intellectual Property (IPI) for the IP rights to a
black-and-white depiction of a Granny Smith apple.

The ripple effects of Apple winning its legal battle would extend far
beyond the tech world. The Fruit Union Suisse, a 111-year-old
organisation, has a logo featuring a red apple with a white Swiss cross superimposed on it. But now the association could find itself in the
position of having to change its logo because the FUS says Apple wants
IP rights to all depictions of apples in general — not just the apple
with the bite in it like Apple's iconic logo.

"We have a hard time understanding this, because it’s not like they’re trying to protect their bitten apple," Jimmy Mariethoz, director of
FUS, said to Wired. "Their objective here is really to own the rights
to an actual apple, which, for us, is something that is really almost
universal … that should be free for everyone to use."

You are a Troll. The first paragraph reads as follows. You shortened it
in an unacceptable way. Nobody cares here in Switzerland: The case is
    not to win for Apple.

Apple has been trying to trademark the apple in Switzerland since 2017

partially awarded Apple's request, citing that generic imagery of common
items are considered to be in the public domain.

Apple has now launched an appeal. Because the case is ongoing and
requires consent from Apple, the IPI couldn't disclose details of its
request, but it involves uses for audiovisual footage.

Yes it does. Very much so. In jurisdictions with Roman Right Apple has
*Zero Chance* to succeed because they already lost the case.

In misc.phone.mobile.iphone your connotation is correct. Look at all
these ridiculous US-right-wing posters which are simply idiots and
Trolls. Or at best Apple fanboys.

To discuss and criticize irreversible decisions taken by the elected EU parliament with very stupid and in a bigger context irrelevant
    considerations is trollish. Very trollish.

P.S.: I use Apple products because they are very good and in most cases superior to the competition. But Apple is commercial enterprise and not
    more.

Up until now I’ve given you the benefit of the doubt considering English is not your native language, but it’s become clear in this thread and the replaceable batteries one that you are not only delusional, but also an extremely socialist government dependent person. If there’s anyone trolling around here it’s surely you with all the political bullshit you’re throwing around.

Nope, not everyone. Just you, sms, "humble" Ronny, and your leader,

here. And whenever anyone else calls you out for it, you guys

'Apple presses Swiss fruit association: Does the apple logo have to go

This is far from the first time Apple has taken legal action to defend

Of course you are - you just express it towards Apple and Apple
customers in a rather cowardly way instead mostly by lying or
mischaracterizing things, like when you recently claimed iPhone
batteries never last five years or more, which is an objectively false
claim and was immediately disputed by several people who have direct
first-hand experience with iPhones lasting 5-7 years on the OEM battery
    - all because you want to make a mountain out of a molehill regarding
the fact that iPhone batteries aren't user-replaceable, even though
people actually rarely need to replace them and replacement can be done relatively cheaply while you wait in most cases. That was a clear troll
on your part, and you couldn't handle anyone calling you out on it, as
    usual.

The record shows I'm not generally rude to everyone here, especially
those who are here seeking and giving genuine help, including when you
ask for genuine help on the few occasions that you do.

Sorry, but Apple is not trying to trademark images of actual apples.

You're accepting the word of someone involved in the dispute.

The Schweizer Früchte changed their logo in 2011 to something that was
    very similar to Apple's logo:

    <https://www.swissfruit.ch/wp-content/themes/dudapress/dist/assets/images/logos/SOV_fruchte_cmyk_pos_de.svg>

Prior to 2011, their logo was this:

    <https://photos5.appleinsider.com/gallery/54990-111552-001-previous-logo-xl.jpg>

I think you'd have to agree the new logo is very similar to Apple's logo.

Not at all. The Swiss one is red and has a white cross on it. Even from a distance they don’t look anything alike.

I think you'd have to agree the new logo is very similar to Apple's logo.

Apple is trying to trademark images of apples – the fruit, not the

Apple has been trying to trademark the apple in Switzerland since 2017
and has launched similar applications in several other countries, per
Wired UK(opens in a new tab). It submitted an application to the Swiss
Institute of Intellectual Property (IPI) for the IP rights to a
black-and-white depiction of a Granny Smith apple.

The ripple effects of Apple winning its legal battle would extend far
beyond the tech world. The Fruit Union Suisse, a 111-year-old
organisation, has a logo featuring a red apple with a white Swiss cross
superimposed on it. But now the association could find itself in the
position of having to change its logo because the FUS says Apple wants
IP rights to all depictions of apples in general — not just the apple
with the bite in it like Apple's iconic logo.

"We have a hard time understanding this, because it’s not like they’re >>> trying to protect their bitten apple," Jimmy Mariethoz, director of
FUS, said to Wired. "Their objective here is really to own the rights
to an actual apple, which, for us, is something that is really almost
universal … that should be free for everyone to use."

Sorry, but Apple is not trying to trademark images of actual apples.

You're accepting the word of someone involved in the dispute.

The Schweizer Früchte changed their logo in 2011 to something that was
    very similar to Apple's logo:

Not at all. The Swiss one is red and has a white cross on it. Even from a distance they don’t look anything alike.

I'm sorry, but the issue of whether or not they are TOO alike is a
matter for the appropriate court to decide.

The new logo is clearly very similar to the Apple logo.

And from a distance, they will look MORE similar.

One of the signs of the anti-Apple troll is your ability to ignore the
    obvious facts.

And I notice you completely ignore that your initial claim...

(That "Apple is trying to trademark depictions of actual apples")

    ...is quite obviously bullshit.
