This is interesting. Judge Merchan has delayed sentencing in Trump's
hush money case until after the election. But significantly, he did not
delay sentencing until after a possible Trump election would be
certified by the Electoral College or even after inauguration when it
would likely be impossible to carry out. So it raises the very
interesting question of what happens if Trump wins the election but is
then sentenced to prison on November 26th.
Assuming Merchan sentences him to actual confinement in a prison and not
"home confinement" or "community service" or something like that, is it
likely he would actually be put in prison while awaiting results from
the electoral college, etc.? Unless he steps down willingly at that
point, which he is not likely to do, the electoral college members have
no reason not to elect him, and I presume we would go all the way to
January 20th and Inauguration Day and then what, he gets a special
visitor's pass to allow the Chief Justice to visit him in his cell and
swear him in? At that point, once he is sworn in, there could be
emergency invocation of the 25th Amen
Course, I suppose Merchan could just sentence him to "Community Service"
and say that serving as president would constitute that, but otherwise
it's just hard to see how this will play out if Trump actually wins the election.
