have a US passport. It takes approximately 10-13 weeks to get a new passport so all our plans and plane tickets will be lost approximately $2000. If it was only $165 to replace then I would have gladly done

With respect to your legal rights, you'll need to read UPS' conditions of contract. I'd be very, very surprised if you have any recourse beyond the cost of shipment and, perhaps, the cost of replacing the passport.

No, they're not. You can obtain a replacement passport in one day for
approximately $165. Just get a new passport.
