    Well, the problem is that requires an intent to defraud. It's not been shown there was any such intent, much less that any such defrauding occurred.
    The loan was paid back in full, with all interest and penalties for early repayment. So who was defrauded?
    Even ASSUMING Trump lied.. no defrauding took place. The loan was secured.
    The loan was issued. The loan was paid back in full. No one was defrauded. Further no one has established there was any INTENT by Trump to do so.

    Now, if he refused to repay the loan, and the property wasn't as he and the bank's own experts found it to be, then maybe there would be a basis for
    such a case as the bank would have been defrauded, and you would only have
    to establish that it was intentional.

    However, the bank did it's OWN due diligence and they confirmed the value
    and condition of the property. They made the loan based on their OWN
    estimates of the value of the property. So even if Trump was attempting to defraud.. he didn't carry it out. That's why banks banks do their own inspections and due diligence. Nor is there any evidence at all that Trump intended to defraud on the loan.

    A crime of intent where there was no crime, or intent seems like a DA
    looking to enjoy the highlife with her boyfriend on the public dime.. Now
    that WOULD be fraud. Indeed, IMO this case is so tainted by the DA and her 'lead investigator' that I don't see how you could possibly not throw out
    the case particularly given any lack of victims, defrauding much less intent
    to do so.

    All I can is investors are already pulling out of New York, lest some self serving DA decided to try to prosecute them for ordinary legal business practices as they have Trump.
